RECORDING STATUTES PRACTICE QUESTIONS
Recording statutes practice questions for Real Property.
Recording problems are priority puzzles. The reliable method is to identify every conveyance, record the order of recording, classify each purchaser, and only then apply the jurisdiction’s recording statute.

What this topic tests
- Race, notice, and race-notice statutory structures
- Bona fide purchaser requirements and value
- Actual, record, and inquiry notice
- Chain-of-title and wild-deed problems
- Shelter rule and later transferees
- Quitclaim deeds, grantor-grantee indexes, and priority consequences
Use the right analysis order
Draw the conveyances in chronological order. For each later purchaser, record whether value was paid and what notice existed at the moment of conveyance. Then apply the statute’s text: race focuses on recording priority, notice protects qualifying purchasers without notice, and race-notice generally requires both protected status and first recording.
Common exam traps
Students often evaluate notice at the wrong time or skip whether the buyer paid value. Another trap is assuming a later purchaser must independently qualify as a bona fide purchaser even when the shelter rule applies.
How to practice it
Use three columns: conveyance, notice at purchase, recording date. Recording-statute questions become much less abstract when the chain is written out.
LAW SCHOOL + BAR REVIEW
Recording statutes are timeline problems.
In Property courses, professors often add deed defects, estoppel by deed, mortgages, or inquiry notice to the same chain. Resolve each transfer before applying the recording act.
For bar review, mix recording questions with mortgages and deed covenants so you practice distinguishing title priority from contractual warranties in the deed.
