MORTGAGES + FORECLOSURE PRACTICE QUESTIONS

Mortgages and foreclosure practice questions for Real Property.

Mortgage problems combine contract, property, and priority rules. Start by identifying each lien, when it arose, and what later events changed priority or the parties’ rights.

What this topic tests

  • Mortgage creation and transfer of debt and security interests
  • Priority among mortgages and other interests
  • Purchase-money mortgage priority
  • Effect of recording statutes on mortgage priority
  • Foreclosure procedure and treatment of junior and senior interests
  • Equity of redemption and statutory redemption concepts
  • Deficiency judgments and distribution of foreclosure proceeds

Use the right analysis order

Build a lien timeline. Determine the normal priority order, then check purchase-money status, recording rules, subordination, modification, or other facts that may alter it. At foreclosure, identify which interests are terminated, which remain, and how proceeds are distributed.

Common exam traps

Students often assume foreclosure wipes out every lien. A foreclosure generally affects interests junior to the foreclosed mortgage differently from senior interests. Another trap is confusing redemption before foreclosure with any statutory post-sale redemption right.

How to practice it

Number the liens in order, then physically mark the lien being foreclosed. Ask what sits above it and below it. That visual method helps determine who must be joined, what survives, and who receives proceeds.

LAW SCHOOL + BAR REVIEW

Mortgage questions are priority questions with remedies attached.

On law school exams, explain both lien priority and the consequences of foreclosure. A correct priority ranking is only the first half of the analysis.

For bar review, pair mortgages with recording statutes and land-sale contracts because priority and notice often determine the result before foreclosure rules are applied.
